The probationer must successfully complete whatever sanctions were imposed by the Judge at their sentencing. The probationer must also complete more than half of their probation to be eligible for early termination of probation. If this probation was involving harm done to a child, then I highly doubt if the Judge will terminate the probation early regardless if the person had good behavior or not. Good behavior only applies to if you are in jail or prison. Good behavior on probation means you have successfully completed everything the Judge sentenced you to do and also did not get arrested for anything else while on probation.

Tks a lot I was sentienced in 2004 for spanking my 14 yr old. I received 8 yrs probation, with no jail time. 240 hrs of community service, and a fine. I am clean of any misbehavior, and have completed all requirements. This march will b 6 yrs that I have served, then only two yrs left. She had welps on her butt and upper legs. She left hm the next day and turned me in to police. She is now 22 yrs old.

You can only find out by sending in a Motion for Early Termination of your probation to the Judge. Have you talked this over with your PO? They can help you if they like you to get terminated early. If not, then have an attorney petition the Judge for you. You might need to have a hearing on this before the Judge as well.

Tks 4 your help. I did call my lawyer this week. He is doing reserch to find out if this charge is legal for a eary out or not, specially since the child is now 22 and has moved on with her life as well. If he finds out it does not qualify, I will b OK since I have gained good statis with the po office by getting to know them 4 almost 6 yrs, and by doing all requirements with no trouble on my part. Also it was the 1st time I had ever been in any type of trouble with the law except for a speeding ticket. The reason all this is coming up is My husband purchased us Alaska tickets for a crusie and I am wondering if I would be allowed 2 go. My po officer said I will have to go before the judge to gain permission 4 that. So that's how the early out issue came about.
