View Full Version : My step daughter said her mother kicked her out of the house. What do we need to do?

My step daughter and her mother fight constantly. Her Mother told her to go live with her father. She took her house key and made her take all of her belongings from her room and load them into her car. She is talking to her counselor at school tomorrow to see if she can drive to that school because we are in a different district and she will be a senior next year. Obviously I am not going to continue paying child support if she is living with us. I want to know what steps we need to take to make this legal. Thank You. I am in MD.

Your husband needs to file with the courts for a custody and placement change.

Yes you will continue to pay child support till you go back to court and get the court order changed, does not matter that she is temp staying with you, until that court order is changed, yes you still legally have to pay.

And personally if it was me, I would have had her just keep driving to school and go, Then let all the legal mess work out before you start telling a public school anything.

I did advise her not to talk to her counseler at school. Unfortunately if she does stay permanetly with us her Mother will no doubt call the school and tell them she is no longer in the district. Thank you for the advice.

Even if she is no longer in the district, the school should still let her finish out the year there. They already received their tax dollars for her for the year; there's no reason to force her to transfer to a new school with only 3-4 months left.

Like we've said, file in court to have physical custody/placement modified. As Fr_Chuck said, you will have to pay child support until the order is modified but you can request that support be reimbursed for the time that the child was living with you.
