View Full Version : Noisy handicap tenant issue!

I live in a rent-stabilized apt. run by DHCR. One of the residents over me is handicap(wheelchair)(mother). However, the rest of family(20+yrs old kids and grandchild) are not. We have constantly been battling a noise problem over our heads for 20+ years from these residents(mom very nasty, and constantly taking mgmt to court) when they were younger. We have been told how hard it is to evict a handicap person since the mother and her husband are the main names on the lease. Our building is 3/4 co-op and has security. We complained to security as well as to the residents, yet the problem still exists. The board handles mostly complaints from shareholders(we are not). We are at end of rope from stomping, jumping, loud music etc, which is against house rules of premises. These residents defy it. What can we legally do?

Record the problem, and sue the landlord.

Your coop unit owner is NOT responsible for the residents living in other condo shareholder's units.

You need to move and your unit owner needs to move in or sell to an owner-occupant who has standing with the coop board. The coop rules & regs need to be beefed up to address the noise issues and this is financially costly.
