View Full Version : USA Tax stayed in USA for only 84 months

I satyed in USA starting 1st January till 25th March a total of 84 days.

1) My parent company is India based and in USA I was getting regular monthly salary.
2) All my State, Federal, SSN, Medicare taxes were withheld.
3) I was in USA with my wife and my kid. My wife has ITIN number.
4) From USA we moved to Canada and since then we are in Canada.

I understand I need to file my taxes as Non Resident.
Do I need to declare my Canada income, am I eligible to get back all my taxex withheld including SSN and medicare.
Can I claim my child benefits.
Are there any other things I need to be aware of while filling for taxex.

Sorry I mentioned above 84 months its actually 84 days.
The year being referred is 2009.

When did you enter the U.S. Did you file 2008 tax return? If yes, filing status. Your visa type? Are you a U.S. citizen or resident?

Thanks for the reply. Below are the details.

1) Yes I filed the taxes for 2008 as well for 2007 and was in USA along with my wife and kid for the entire duration of 2007 and 2008 (If this is to confirm substantial presence test). We were staying in California.
2) Filing status is jointly with my spouse (my spouse is non working).
4) I am not a USA citizen but I am Indian citizen and was on L1B visa in USA.

As I understand that I pass substantial presence test so am I in a position to file the taxes as Resident or do I need to file as NR.

You are dual status for 2009-- resident up to March 2009 and nonresident after that. File dual status tax return.

Is there a software which supports filing dual tax returns.

Most softwares do not do dual status return.
