My son's dad is a canadian citizen (but born in Thailand). He is here on a passport and we are trying to get his green card. His lawer told him the only ways are either give him custody of my son or marry him. I do want to marry him but not right now and not for this reason. And I definitely am not giving him custody of our son. My question is is there such thing as giving him half custody? And would that really help him? Would he still have to pay child support? He is on child support but he said they can still deport him... I live in Massachusetts

Are you US citizen? What is is visa status?

I am a us citizen.. I am not sure about his visa? Is that the thing he needs to work? They won't give it to him for some reason.. I also asked him why can't one ofhis family members sponsor him and he said they denied him for that also

Not much to do with child custody but the fact that he is responsible for child support would be a big help. To obtain immigrant visa, one must have a sponsor.. and this sponsor must be US citizen. If he is now in Canada, you should get married and obtain spouse visa for him. If he is already in US, then get married and file for adjustment of status.

Yeah I was planning on marrying him but I'm not going to just marry him so he can get his green card. He's going to have to wait until I finish school at the end of the year and really change his attitude.. I already told him if he has to move back to Canada we would go visit him.. If not just move there it's not THAT far lol thanks for your help
