I work for a company in California. I get paid on a salary basis bi-weekly. I have to clock in and clock out on a daily basis. I work for 8 hours a day and ½ hour for lunch, that is 8.30 hours a day. I am required to complete 8 hours a day, not matter what. Last week I was not keeping well and I went home ½ day and I took 1 full day of time off due to my sickness. Now they are docking my pay for 1.2 days. That is as per my employer if I did not work more than 80 hours, so they will dock my pay. Last pay period (Jan1-Jan 15), I worked for a total of 92.50 hours. It also included 8 hours of holiday for Jan 1st. So as per my time sheet I worked 84.50 regular hours, and they added 8 hours for Jan 1st holiday, that totals up to 92.50.
Is it right to dock my pay if I am take 1 day leave or go home ½ a day. If so, am I not entitled to received over –time if I work more than 80 hours?
