Can someone with a criminal record be an assurity?

Are you referring to a surety bail bond?

These bonds are insured/guaranteed but it is the decision of the bondsman whether to accept a person. I don't believe a criminal record is an impediment - but, again, it's the bondsman's decision.

I have recently came to conclusion that it is not possible or on rare, very rare occasions that a judge, crown or bondsman will allow a person with a criminal record to act as an assurety.

I agree. In principle, a surety should be evaluated solely by the value of his or her assets. The surety's criminal record has nothing to do with the security of the bond.

I paid the assurity bond at the clerks office. Do I get that money back if he is going to be incarserated
