Hi all, in regards to getting your deductible back, what if:
1) it was the other driver's fault (in my case a truck driver in a company 18-wheeler)
2) he rolled back into MY car, I got his license plate #, tried to pull him over and he wouldn't so I then called 911 - the cop told me to stop following him and pull over immediately. Cop supposedly tried to intercept the truck since it was during rush hour traffic but claims he could not track him down
3) cop deemed in his report that it was a "hit & run" and driver was at fault
4) When driver was tracked down and questioned by cop, he LIED and said "I HIT HIS TRUCK" (then why the hell didn't he pull over, right?)
5) His insurance co. is of course accepting no liability/fault
6) My adjustor tells me my claim is now turned over to their "Collections" Dept. How do I know they're collecting my deductible $ and not just the $ they had to pay my body shop?

Because it is what they are supposed to do; recover the full amount of your loss.

Actually they are required to recover the full amount of the claim. If they recover they will refund your deductible.

But don't count on any recovery. It will probably cost them more than they paid out to recover anything so they will not be very motivated.

In the future, you don't leave the scene either. You should have called 911 reported the tag of the truck and remained at the scene.

You could have course sue them pesonally for the deductable amount if you wish.

You may not ever get it from the insurance company, if they decide it is not worth the money to sue.
