View Full Version : Title to Mobile Home CLEAR?

We purchased a used MH in 1999. The company (A) sent us the title showing no lienholders (clear).
Recently, Company A went out of business and a new company (B) took over. They began calling us about our "past due payments". They claimed to have the title.
I called the county tax office where we purchased the home and sure enough, they have a DUPLICATE title on file showing company A as a lienholder. The original title was issued Sept. 1999, the duplicate was issued May 2000.
Is my title CLEAR or not? The tax office says that the duplicate title made MY original title void! How is that legal? And the only help she could offer was that as of May 2010 it will be 10 years old and I can legally have a third duplicate title made and remove Company A as lienholder without getting a lien release from them.
All of our home papers burned up in a fire several years ago... thankfully the title to our home was not among them. But I can't find the paid receipts anymore.
Can I get them off the lien NOW and probably end up fighting in court with NO proof of payment or should I wait until May and just have a new title made?

Did you finance the mh originally with Company A?

When you bought it, was there a loan, if there was, they are suppose to have a lien.

I don't see where the 10 year issue, a lost title is for anytime it is lost, not to remove a lien, You should not be able to remove a lien unless you prove it is false or paid
