My ex has filled a motion to suspend his child support payments until he has found a job however back in the year 94 papers where filled in toronto courts, now he is living in Hamilton and this motion was drawn up in hamilton, I was told because I have both children living with me in brampton, I don't have to go to hamilton... and those papers should have never been done by the Hamilton courts, Is this true? I am also expecting another child around the time I'm due to go to court I''m at high risk of pre-mature labour can I get a doctor's note to change the court date... please let me know

You need to contact the court to request a change of venue or a postponement. Your attorney can probably have an affiliate in the area file the paper work.

Yes as Scoot said, you can't merely ignore the court paperwork, you will have to file at least a motion to have that case dismissed since it should not have jurisdiction over the case, or as scott mentioned, a change of venue to the proper court.

Generally, wherever the payor lives holds jurisdiction over child support matters. The case would be filed in the father's place of residence. I don't know about getting a continuance because of your medical condition. Check with your attorney.
