Spouse did not work in 2009, can I claim her as a dependent ? How do I claim to get the most refund?

File as Married Filing Jointly, and you will most likely get the max refund.

On the joint return your standard deduction is $11,400 and you get two exemptions even when one spouse did not have any income.
