In the state of New York is this the case also? If you signed a lease to give 60 days notice and stay past the end of the lease as a month to month tenant do you have to give 60 days or 30 days when you move? Thanks.

First of all, it's not a good idea to piggyback your question onto someone else's; it makes it harder for us to find it and harder to give you an answer. This thread is originally from 2006. I've asked that the moderators move it to a new thread.

Second, it all depends on the circumstances. Does your lease say anything about automatic renewal without having to sign a new lease? How long did you stay past the terms of the lease? When did you give notification and when did you actually vacate?

When you have a signed lease that expires and you become a month-to-month tenant, it is at the same terms and conditions as the original signed lease except for the length of time. So if the original lease required that you give 60 days notice, then you still have to give 60 days notice now.
