I received a 3 day notice to tenant. If I do not pay the rent do I need to vacate in three days or do I have thirty days?

Not enough details,

How late are you, is this a notice prior to a eviction hearing, or is this a 3 day notice from the court ?

How did you receive the notice? If it was served to you, you can pay before the end of the 3 day period by cash, certified check or money order. If you normally paid with a personal check, the landlord must accept it, if still within the 3 days. The landlord cannot demand more than the amount of the full rent, like tagging on late charges. If the landlord accepts partial payment of the rent, they waive rights to evict you. I would suggest that you work it out with the landlord and communicate. Otherwidse they can file an eviction lawsuit. I'm not a lawyer, but that is what I understand for California.

It depends. Are you going to have the full rent shortly? Do you want to move? What state do you live in?

It's true, he doesn't have to accept partial rent, but if you get the full rent together before your eviction court date (10 days maybe after the end of the 3 day notice?? ), he must take it, and you're back in good stead.
