I have about 60,000 in credit card dept. My wife lost her job can't make the min. payments anymore. Can they take my quad, motorcycle, her car my truck... They are all paid off. I have the titles on all of them, should I put them in someone else's name? Do I get an Attorney ?

Help?

You need to speak to a bankruptcy attorney who can advise you. There are two types of bk. Chapter 7 and 13
You will have to take a means test to find out which one you qualify for also you will be required to take a credit counseling class. Exemptions vary from state to state so make an appt with an attorney and see what will work for you also putting the titles in some else name will not work you have to disclose what you have and what you owe and if you put these in someone else's name prior to filing bk it could land you in trouble

No you can't put them into someone else's name, that if fraud and when found, they will make it a lot worst.

You are allowed specific exemptions that you can keep, so depending on the value of each, you may get to keep them, or you may have to sell some off to pay toward the debt ( which is of course only right, from a legal and moral viewpoint, since it is a legal debt and if you own property that can help pay that debt, that is what happens.

The attorney can tell you what exemptions are, and there is also income to debt ratios that have to be meet.

Also they will look at some of the last items purchased, where they purchased after income was lost, was there any intent to defraud and so on.
