Parking lot accident in Louisiana Pecanland Mall-posted speed limit sign is 10mph, car B in sworn testimony says she was going 20mph. Car B comes sharply around the corner (over a pedistrian walkway) and her passenger tire hits the corner of Car A that had stopped before entering the throughway (Car A is on a feeder road). Car B tells insurance adjuster that the speed limit is 25 mph and she was going 20mph. Is this a 50/50 case or does Car B stating that they were going DOUBLE the speed limit make a difference for insurance purposes?

First Lousiana does not use the same legal base as the rest of the US and I am not up on their specific laws.

Speeding while may be a factor has little to do with this in the fact that speed limits in private parking lots are not "legally" set by the city or state and not inforceable, merely a safety guidline set by the owners of the lot.

If Car A is sitting in a proper area, not moving at all. And Car B hits a parked vechile, even if going under the speed limit, Car B is totally at fault.
