I'm with my new partner but my son lives with his father he has a residence order will my new partner be able to adopt him still. I see see my son regular my new partner still wants him to stay with his dad but he wants to adopt him

Both parties have to agree to the adoption, both the mother and the father.

Will the father consent? If not, the answer is no.

Why would your partner want to adopt your son when he already has a biological father that he lives with? What does the father think of this?

Please pay more attention to posting guidelines. There is a Read First sticky in the Adoption forum (where this was moved from) that directs questions of a legal nature to this forum.

Your request doesn't make sense. An adoption severs the rights of the legal parent in favor of the adoptive parent. Why would his father agree when he has custody.

A step parent adoption usually occurs when the bio parent is out of the picture. Why would your new partner want to adopt?

Do you and your new partner know what it means to adopt? It means that he would become the legal parent and the father becomes just another man on the street.
