I was charged with simple possession I talked to the DA myself and was offered a deal of 11/29 probation,500 dollar fine and 18 hours communitity service. Can I get a better deal with a public defender by my side?

Hello let:

Probably not, but they're free so I'd sure try...

I'm concerned that the DA even spoke to you. He should NOT have, or if he did, he should have told you that you NEED an attorney to do the negotiation with him...

If he didn't do that, it would be a violation of his ethical standards. Maybe your lawyer can exploit it...

PS> I don't know what substance you were in simple possession of, but if it was marijuana, your state is committing a crime against YOU.

Yes and if the deal is not in writing, there is no deal. I would never agree, or even talk to the police and esp not to the DA without an attorney present.

If it's your 1st time in trouble, maybe you can enter a diversion program to avoid a conviction or have the crime lowered. Maybe that is the best deal,it's always good to have a lawyer.
