I wrote before telling about getting my license suspended for "obtaining a license by fraud". I wrote the question (which was poorly worded) "Is it better to not drive or have a felony".

Anyway, instead of getting an attorney, I called the DMV and they told me that my license was suspended for one year. I get it back in Aug. I never went to court and so I don't have any criminal charges on my record.

If I apply for a hardship license, I have to have a court hearing. If I have a hearing can they decided to give me criminal charges, or will they just decide whether to give me a hardship license? Are they going to ask me a whole bunch of questions about why I did what I did?

I'm sure they won't use the opportunity to bring up criminal charges... They don't happen by accident, you know. Somebody has decided to charge you, or not.

In terms of them asking you about what you did, I'm sure they will. I don't know why you think it doesn't have anything to do with their decision to give you license. It surly DOES.

The court can not actually "charge you" the DA has to, and request for hard ship license is merely a formal request before the judge, no one is trying to deny it, you merely have to just prove you need it

I guess I'm just nervous, but I probably should just apply for my hardship license.
