View Full Version : What is the Grace period of K-1 Visa and Can it be converted into an F-1 Visa

Dear Sir,

I came to USA on a K-1 Visa since my fiancé is a US National here. My visa requires me to get married to my fiancé within 90 days from the date of my entry to USA. Unfortunately things didn't turn out well and due to lack of undertstanding we have decided NOT to get married now. My I-94 form will expire in 2 weeks time now.

My question is :

1. What is the grace period of over staying on a K-1 Visa? I have heard that I can stay for 6 months more after my I-94 expires.

2. I don't want to leave USA and also don't want to stay here illegally so is there any way I can change my Visa from K-1 to any other category (for example : F-1 Visa) which will allow to leave here in USA legally for some more time.

3. Is there ANY solution to my problem.

PLEASE help me out because Iam very much confused and don't know what to do and who to turn to since I have very limited time before my K-1 Status expires in another 2 weeks time.

There is no grace period for K-1 visa. If you're not married in 90 days, you must leave US. No change of status to other category... and no other alternative. If you marry someone else, you can't adjust status in US, you must return to your home country for visa interview.

Leave US first and then apply for F-1 from your country.

Thank you very much for your reply. Is it possible for me to apply for a Visit Visa to Canada while Iam on my K-1 Visa status here in US?
