View Full Version : What can happen after you've served your probation sentence?

My boyfriend's been in jail for 4 months and hasn't had a probation violation hearing yet. His probation was done on the Dec 7th, but he doesn't go to court until the 11th. What can happen at that hearing? (This is his first probation violation)

Technically his probation is over as of December 7th. BUT technically it has not been terminated by the Judge so technically he is still on probation until he attends his probation violation hearing at which time the Judge may decide to sentence him back to jail or give him more probation to do. Just because your "end date" has come and gone you are still on probation until the Judge signs a termination of probation order. You are confusing things as you don't realize when the probation legally ends - when the Judge signs the order and not until.

When probation is violated, the time stops running. If the violation is sustained, he can be made to serve the entire underlying sentence... Or, they could let him go.
