So on Aug 08, I got caught for theft under 5000, completed my diversion program by November, and sent a letter to fingerprint dept to destroy all my fingerprints/photos in December. It is now dec 09 and I was just wondering if anyone knows the answer to this question. If I was to go to the United States, at the border, would they still be able to see that I got arrested or anything of that nature? Would they ask me about it type of thing? I would assume no, but was just wondering if anyone has experience with a similar situation to give me an answer?

If you were IN the US, while to the public the records are sealed, but for police and national security searches, it will show up and show it was taken care of in diverstion program

Yes, it will show up. It's visible to the authorities. I'm former US Customs/Immigration.

So if I go across the border for sure the officer there will question me about it? Or will he just see it and not bother? Is it a serious enough thing to question about?

If they run a computer check on you, the fact you were in the program shows up. See no reason to question it, unless you catch someone on a bad day and they want to mess with you for some other reason
