I am on L1A and my wife and kid is on L2 dependent visa. I have SSN and my wife and son doesn't have SSN and are not working. They are dependent on my income. I have declared them as my dependents. I have few questions:-

1) When can I apply for ITIN for them?
2) Whether applying for ITIN for both of them, I have to specify any category for them (as they don't have SSN and I am applying ITIN for them)?
3) What document I need to furnish for them?

2) Whether we all 3 can file jointly. If yes, any special comments on it or any special points to be taken?
3) Whether applying for ITIN for both of them, I have to specify any category for them (as they dont have SSN and I am applying ITIN for them)?

1 & 2, 4) You can file jointly with your wife and you both CHOSE to be treated as resident aliens. This will allow you to claim the $11,100 joint standard deduction plus two $3,600 personal exemption (for yourself and your wife) plus one $3,600 for your child PLUS the $1,000 Child Tax Credit.

You will need to submit Forms W-7 to apply for ITINs for your wife and child. A notarized photocopy of their passport needs to be stapled to the W-7.
