I am 34 years old, laid-off , in school, and yes living with my Mother with her permission. Stipulation: stay in school. I've been on unemployment since Jan. '09, have one more semester (or 2), paying my own way with over $1500 saved( in my mother's possesion). Here is my problem: my older Brother lives with us as well, has not held a job in over 3 years (since the last job I got for him and he quit, and the one before that too), quit school himself and is pickled on vodka. At least twice a week he is blaring the stereo until all hours of the morning, keeping me from a decent night sleep. Although only community college, I feel as if I am at the summit, and it is not exactly easy. I need sleep. My brother is hiding from a warrant, and I've stated that unless he can keep it down and sleep nights and go out and look for a job during the day ( or go to church or something) I'm going to call the police. I have some grants and don't want to lose this opportunity. Now my mother tells me if I turn him in, she will have me removed from the house. I'm at the point where I am ready to leave, I'll go stay in the Salvation Army, it's finals week next week for crying out loud and I am teetering on the edge of insanity. However she won't give me the money I've saved and I can't continue like this. Can she kick me out? I think she looks the other way from my Brother because they ran away from my Father in the middle of the night with $10,000 and still feels a bit of guilt. What can I do?

She can evict you and may not know how to go about it properly so it could take more than 30 days. So mom is willing to harbor him and break the law herself, nice.

Well first mistake was to "threaten" you should have just turned him in if you were going to and not made a big production out of it.

Next you are a adult, so why is your mom holding your money ?

She can evict you with a 30 day notice legally, Illegally she can just set your stuff on the yard and then you have to find a place to live and could sue her.

Does she even have the money you gave her or is it spent and she does not have it to give you?

You can put up with it, figure a way to make his sterio not work or move somewhere
