Is it fraud when a bank and mortgage co knowing the payment was misplace and cover up the error in which the mortgage has made and take a person home from them knowing they were wrong

If a mortgage co has made many errors in a mortgage account and try to cover it up that they have made errors and made it look like the customer was wrong is this fard and under what law MCR is this under and what dose it say

Just one payment being misplaced should not be enough for a company to attempt to forclose.

And often you will have trouble proving any criminal activity unless there is a pattern of this, normally it will be merely a civil issue.

You also have not really provided any information, what type of error, how many payments, If it is an accounting error, then this merely would have to be proved in a foreclosure hearing.

You really need to give more info. If you mailed a payment and the co says they never received it, what proof do you have that they did?
