View Full Version : How To Evict A Non-Paying Family Member

Last Dec my father showed up in my driveway in the freezing weather, he said he had no where to go. Out of the kindness of my heart I took him in. It was only supposed to be for a few weeks, until he found other arrangements. He actually ended up staying the entire winter... He was getting unemployment at the time, but never paid us any money... I told him that we could not financially afford taking care of him any longer, and asked him to move out 10/31 this year, I gave him 1 1/2 months notice. We live in Will County, Illinois. He left for about two weeks said he was working on a job, I thought he was gone, to find him sleeping in my driveway again two nights ago... He has a habit of staying with people and getting kicked out, he is not an easy person to live with, he uses people for as long as he can... Well now they cut my husbands hours at work and we can not afford him here any more... What can I do legally to get him out of my house for good... I have given him information on shelters, he has a brother, and 5 other children that he can go to and ask for help... What can I do legally, Please advise Thank You, I am mentally exhausted... He is 60 or 61 years old... He can't get social security yet, and his unemployment has run out... He has been on it over a year now . I am mentally exhausted, Thank You For your help Kelly

Please do not ask the question more than once, I have merged your questions
Well two weeks ago, why did you let him back in the house, and what will you do next week when he is in drive way again.
You need to give him a official legal notice ( if you let him move back in) and make it in writing. Depending on where you live from a 15 to a 30 day notice and if he is not out, you file a formal eviction in court
