I need to get copies of my paycheck stubs and timecards stating when I worked and how much I was paid from my employer in 2008; she is refusing to give me them so my question is can she do that legally?

This depends on which state you live in as different states have different rules on records and what must be available to the employee and for how long it must be available.

You can call your local Department of Labor and receive this information.

If you wish me to look it up for you than I need to know in whch state you work.

I told that to my former employer and she is saying that my timecards are not in my personnel file- I would like to know where she is keeping all this stuff. First it is very likely they don't have the time cards. Is there a reason, like do you believe they are cheating you on your tme? I f so you may get them as a request for evidence.

The company should supply you a print out of your hours and times

I need them for a claim with county and I feel the employer is not sending correct info. I would like to match them to what I have so there is proof.
