I just have a situation that I am not sure how to handle.
My Husband has been contacted by our apartment that we rented before we bought our home. We lived there for over 2 years before we moved out I did not resign the lease after the first year we lived there on a month to month basis and I was the only signer, as at the time of renting my husbands credit was not so good. We gave our notice to move out on Dec 1/04 and we cleaned the apartment and handed in the keys and the whole 9 yards. They also had my last months rent that I did not get back. They were having problems with the landlord at the time and was fired very shortly after we moved like 2 months later. When we were contact 2 months after we moved out they sd we owed a months rent. I explained no I gave notice they stated they didn't have anything I produced the letter that I had given the landlord they sd well there is no signature to bad. We refused to pay it as we had nothing but problems with the drunk landlord while living there and we handed in our notice. Now almost 2 years since we moved out they are saying my husband who did not even sign the origanal lease owes over $1900 dollars for rent. We did all that we should have done on our end. I don't know how we should handle this as they are saying they are going to take him to court for this now. Any help out there?

Merely deny that you owe anything, the person who is not the renter can not owe anything.

Wait till they either sue or don't sue and then fight it in court.

You could hire an attorney to write them a letter to stop all actions and the such, if you would like. ( not that they have to, but a letter from an attorney often scares people)

But mainly never admit you owe them anything, and demand eveything from them in writing. Don't give them the original of any paper work you have

If I ask for a copy of the lease proving that his signature was not on it they have to produce that. Is that correct?? :confused:

Unless it goes to court, they really don't have to show you anything basically, and remember they could have anyone add his name to it like he signed it.

Don't let them scare you, this is a common thing bad companies do, they go back two or three years and bill people money, and hope some pay, that is free money to them. Or hope you agree to some settlement and so on.

You can of course deny and say prove it, but if they are not honest that really does not matter until you get to court.

You lived in an apartment month to month and your husband signed no lease... that is interesting... made for TV moment... question did you give the landlord a security deposit? What state do you reside for all rental laws are different by state? For Father Chuck is correct...

I am in Ontario Canada actually, yes for the first year we were on a lease then the second we lived month to month.. we paid first and last when we moved in.
