Hello,

My name is Tom. I was divorced in Alabama. I have a son who is turning 19 soon. The divorce decree states that I must pay child support until he turns 19. Am I obligated to pay child support if he is attending college after he turns 19?

If the support order only says you have to pay until age 19, then you can stop at 19.

As an aside though, I hope that if he's in college trying to better himself that you continue to help him and support him as a parent.

Did it actually say until 19 or did it say completion of high school or 19 ? Many states run until 18 or until 21 in a few. The main thing in going past the 18th birthday is the completion of high school.

Also if he is no longer living at home that may be an issue. If he's close to 19 then it may be best to let it ride because the courts won't act quicly in this situation. Also if your paying through a state agency for supprt you need to tell them at least 6 months in advance that he is turning 19.
