View Full Version : NYC landlord not returning security deposit.

Hello. Moved about 1mo ago from NYC apartment and have not received my deposit nor a letter or phone call indicating what they are doing with our deposit!

Very confused because in the last 4yrs only spoke with my super never the landlord. Super inspected apt before we left, said everything looks OK, except for damage to one door. Said landlord would return deposit, but ultimately her decision.

I never had a written lease, years ago landlord's son rented apt to us through a realty company and kept telling us we'd get a lease but never got anything, just an address to mail our monthly checks. Super is person we dealt with. I've asked super and his wife for landlord's phone # but they refuse to give it to me!!

So I'm really not sure how to handle this. Do I take them all to small claims court?

First, NYC does not have a specific time frame. The law refers to a reasonable time which is generally considered between 30-60 days. So it would appear the landlord has more time.

I would wait until 60 days have passed, then file in small claims court.

In the meantime you check with the county clerk to determine who is listed as the owner of the property.
