View Full Version : Can my boyfriend adopt my daughter if her father ha not been there at all?

My daughter's father has not been in her life at all, he only seen her once when she was one month old and she is now almost three. I am planning on getting married to my current boyfriend , and he wants to adopt my daughter I need to know if he can do that without having to find the sperm donor and having him sign over his right's!!

First, Please pay more attention to posting guidelines. There is a sticky note at the top of the adoption forum (where this was moved from), that refers questions of a legal nature to this forum. 
 
Second, a sperm donor is someone who donates sperm either for in vitro fertilization or through a sperm bank. It is NOT someone you had sexual intercourse with. 
 
Finally, an adoption is a legal process. The law requires that permission be obtained for a step parent adoption ro that a resonable effort be made to obtain such permission. 
 
You will need an attorney to prepare the adoption petition. Your attorney will tell you what needs to be done.

Well if you had gotten a custody order and had the sperm donor paying child support,  I am sure he would be a lot happier to sign over rights, if he could get out of paying future support.
 
But no,  you will have to find the sperm donor ;and get him to sign over his rights.
