I am wondering what the parents rights are concerning pressing charges. A 15 yr. old girl is sexually assaulted by her 13 yr. old boyfriend/exboyfriend. Can the parent press charges without the child's concent?

She is underage, jmom, yes of course her parents can press charges, sexually assaulting a minor is a very serious offence. What the heck was the l3 year old boy thinking?? And at that age for both of them, why were they left alone in a position to do this ? There are going to be a lot of questions in this one !

Actually this depends on local laws. In some cases, its up to the local prosecutor as to whether to prosecute the case.

What proof do you have of sexual assault? It could very well go the other way and your daughter could be charged with statutory rape.

We would need more details to give good advice here. But legally, yes, you can swear out a complaint on your daughter's behalf because she is underage.

I just caution you to consult an attorney first as such an action could backfire.
