My daughters boyfriend decided that he didn't want to be a father to their 2 childern, ages 4 months and 3 years, anymore. He refuses to move out of their section 8 apartment and she can't make him move because he's on the lease. He refuses to give her any money to buy diapers and other essentials needed for their two children. My daughter doesn't work because the 3 year old is autistic and needs to be watched consently.

My question is can she take him to court and get child support from him even though he still lives with them?

Not so long as he is under the same roof. How could they determine custody in the same household ? It doesn't work that way. Are they on other forms of state aid besides the section 8 housing ?
