View Full Version : Cannot get a straight answer from DHS!

My niece has been investigated for abusing my nephew. The "supposed" father of the baby will not have anything to do with him or acknowledge paternity. She left town for a couple days and left the baby with the "supposed" fathers mother. Now she is being told from the DHS lady that investigated the supposed abuse that she cannot come and get her baby or she will file emergency pick up orders and have her arrested. They have no court papers saying that they are trying to revoke my nieces rights, nor do they a paternity test to show that is even her grandchild. My niece is wanting me to take her son and sign her rights over to me so I can eventually adopt him, since I am family and she knows that she cannot take care of him. I guess my question is what legal right do I have to go and get the baby, and can DHS legally keep family from the baby?

First of all... what is DHS?

I assume she means DFS (Department of Family Services) which is Child Protection.

As the aunt... you have no rights at all. If the child is removed from the parents, you can apply for guardianship.
