In New York, how difficult is it to change a child under 10 yrs. Name to that of their biological father's without his consent? He voluntarily pays support but there is no court stipulated amount so it varies. He refuses to give consent for name change even though there is a court certified paternity affiliation which HE brought legal action to get. He is married with a family and wants to keep this child a secret.

Want to know how to get him to agree?
Get a lawyer, and go to court for child support.
It's hard to keep a secret when the courts are sending stuff to your house.
Of course, that's blackmail---you let him off the hook for legal child support in return for him giving you what you want.
Either way, the kid is the one that's screwed. Go to court and get child support and get your kid in counseling so that he/she doesn't feel as though he/she is something to be ashamed of because of the way his/her father acts.

How difficult is it? Depends... do you want to commit a felony? NO? Then its nearly impossible.
