My partner and I have just moved in together. We live in BC with my child. I get no child support from my ex.
His ex and child live in Alberta.
He has been legally separated for 2 and a half years. They are NOT divorced as of yet.
He is having his child support varied right now, waiting for the alberta courts to receive it from family justice.
He is making half of what he used to make 3 years ago, but they still have not put this through.
He wants to claim hardship, or put a stay order in place or an interim, because all his money is going to her. He can't afford to live.
He was advised by our family justice here (in BC) that he was to only pay the new amount to family maintenance, while waiting for the order to go through. But they sent him a letter saying they would take his drivers licence away from him and he was now in arrears. So they garnisheed his wages. So now... he nets 1200 every two weeks and his child support is $850 per month, plus he has to pay his boss back for the amonut they took, which is 200 per pay cheque. As you can see, he has no money to live on, he can't make his rent each month, can't pay any of his bills and now has to declare bankruptcy, because of this outrageous amount in child support... this is only for one child.
His ex calls at all hours of the day and night, leaving harassing messages and threats to him and I. Lies to her child and has her call here, crying for her to leave me and that she wants him for herself. This is all the mothrs doing by the way. She tells her to i.e. it's really sad.
We have recorded all these messages and were thinking of putting a restraining order on the mother. We have a lot of nasty emails as well.
I have blocked the mother's cell phone during the day, while my boyfriend is at work, so MY children don't hear her messages. But have to unblock them at night, so he can call her... and in case of emergencies.
Also, according to the alberta courts, the ex has put a restraining order on him and she still calls him Can I call the police about this?
Please please help... we are getting the run around... they won't hurry with the varience, they said it could take a year.
There is also a chance that he may be laid off in a couple of weeks when this job is complete... how is he supposed to pay his child support if he doesn't have work and he has to wait 6 weeks before EI would kick in??
