Yes you can adopt an adult at anytime and it doesn't take the parents permission to do so. The only problem you face at this time is her competency. If as you say she is regaurded as mentally challenged then mostly its going to depend on how severe it is. Can she live out life on her own or does she need assistence ?

She would need supervision She can only read on 3rd grade level She also has a 4 month old baby It really worries me that she can be taken advantage of very easy She got pregnant on a visit to her mothers in Texas

What type of custody were you given ? Are the parents still tied to the child at this time ? What state are they in ?

The reason for asking is because in Indiana child supprt runs until 21 and there are no emancipation laws.

If everything is on your side and you still wish to adopt then your going to need representation for your grand daughter as her capacity is diminished. The family courts there can advise you on how best to handle that. Then the rest is just paperwork. And cngrats for taking care of her in the times when you should be living life again on your own.
