Here goes. Im vurrently on probation for a simple assault.. Getting a ne wcharge of agravated assault.. I know thyt can't give me a vop cause the incedent they are trying to charge me with now happen before the incident that landed me on proabtion.. My question is will they take into consderation that I have not been in trouble or anything since probation and be leant on me seeing how this happened before what I got on probation 4.. I mean I have not got in any trobule or anytihng since. Technically 2 this new charge I did not even commit.. I know who did it but just did not give up any name but other than to my lawyer.. My question is are they going to throw the book or will they be nice due to the fact this was from before my org charge and look at it like I have llearned my lesson or they going to look at it like see here he goes again..

What sucks is that I did not even commit the crime. I know they are neva nice but do they take into conserration that this happened before my origannly crime that got me on probation. Instead of saying he's bad he's just going to get in more trouble lets throw the book at him. Will they take into fact that I have not been in trobule since probation and keep me out of jail and just give me more probation and counciling or something.. I have done no councling or nothing at that. Or will they look at it as he just a repeat offender.. It also sucks its nine months later that they finally bringing charges and on the wrong perosn at that. I would think any credabble lawyer should be able to eat it up..

You keep asking me what THEY'LL do. The fact is, I have NO idea. Nobody does. Not all judges are the same. Not all prosecutors are the same. All you can do is present YOUR side of the situation to the judge, and he's going to do, what he's going to do.
You'll have an opportunity to present mitigating evidence to the judge before sentencing. That's the stuff that COUNTERS what the prosecutor is going to say about you. You can present character references in the form of letters, and I would. Make sure you lawyer tells the judge what you told us here. DON'T tell the judge you didn't do it. They don't like that. Take responsibility for the crime. SHOW remorse. If you have none, fake it.
There ain't nothing more you can do.

Thank you sorry for the repative question. I just didn't know.. Ima going to fight considering I did not do it.. I just hate telling on a friend but I don't want to be punsihed for something he has done.. TO top ot off I have a family to loose.. Does it play a important factor that it took them 9 months to finally bring charges on this..

Couple things. You CAN plead not guilty WITHOUT snitching on your friend, and it makes NO difference that it took them some time.

Just figured it being so ong it gave people so much time to fabracate stories.. Figured if they had any good evidence they would have been doing osmething shorty after the incident. Definattly pleading not guilty.. Cause I'm not.. There are to many holes in I believe in why they don't have a good case. First and foremost I'm not gulty. But many other holes..
