I have a friend who I am tryign to help out we live in Missouri. He stopped visiting his kids in 04 due to fighting with the mom of the boys, he didn't fell that it was right to have his kids see them fight every time they saw each other. So he stopped coming around he would call them and they would never be home and she would never call him back so he hit a down whirl and had a pretty ruff time with it all and didn't get around to seeing them at all. In 2007 he had got a paper stating that he had his rights taken away from him. He didn't have any money to fight it he is a full time student. He has cleaned up and he feels that he was done wrong and he really would like to fight to have some kind of visitation with them. And if he had his rights taken away, he didn't give his rights up can the mothers new husband adopt the boys with out his consent. The family service lady told him that he would be better off to just start a new family. There has to be something that he can do right??

Once a parents rights are taken away it is too late to get them back.

He should have went back to court and taken care of her behavior there. He could have had it put in the order that picking up and dropping off the kids was to be done at a public place or a police station or by third party people.

He pretty much can only wait until they are 18.

How is it possible they can just take his rights away he wasent a danger to his kids and he was paying child support all they way up till 07. The mom lives near springfiled and he lives close to st. louis doesn't he have to be served before they can take him to court to take his rights she didn't even give the court the right address for him even though she knew that he lived no were near there, isn't that illegal??

By publication.

She states she has no idea where he is, they print an ad in the paper for a certain number of weeks that there will be a hearing on it, and if he doesn't show, then the judge terminates parental rights so that an adoption can go through.

The ONLY way he can get his kids back is if he PROVES that she lied in court, that there was never notification, and that the grounds for removing his parental rights were false.

This is going to take a lawyer and a lot of money. It could drag on for years. And in the end, the chances of it working are very low.

Please check into whether service by publication was the method they took. Some states don't allow service by publication. MY other suggestion is as mentioned above if he was paying up until 2007 when were the parental rights revoked and was the last address the child support office have for him the same address as the one used for service or service of publication. Don't give up hope. There is most likely a loop hole. Keep digging.
