My husband (the bread winner) left me and our 8 yr old son without enough to pay our food elec, mortgage. He quit his job and claims the little money he has has to go for himself. I called mortgage co to order a hardship and sent out my paperwork in the meantime should I consider asking them if I can take my name off the mortgage so I don't get a foreclosure ? Seems in NC he has not committed any crime ---Obviously I cannot get a lawyer with having to come up with grocery money for my son. What are my options now... No legal aide in this locale, before he left we put the house on the market... The house is now up for sale... please advise me... AT MY WITS END

It's not a crime in North Carolina to fail to pay child support when one has the ability to do so? I find that very hard to believe.
The mortgagee is very unlikely to take your name off the mortgage. But the main adverse consequense of foreclosure to you would be loss of your home. Obviously that would be an extreme hardship to you, but I don't know why would make a difference to the mortgage company.

Well the hardship is like a modification because of husband losing job (or quitting it). I have never heard of this happening before to anyone to this extent. He is not ordered to pay the child support he has only filed for separation, but still "shows" no income.
Any more ideas or laws I need to know on this I could get on this manner this matter and what is unfortunately happening I would appreciate it
