I am a musician . Staff at a rehab center recognized me made copies of my file picture and harassed me to autograph them! Is that a hippa violation ?

It might be. It also might be a criminal violation. I'd talk to a lawyer.

HIPAA violation would be the staff revealing your medical condition to a 3rd party without your consent.

I'd be glad that someone wanted my autograph, rather than complain about it... but what do I know?

File photo? Never seen that at any rehab, but anyway, it was poor behavior on the staff and I am sure against rehab policy. We work with many famous people at the facility I work at and that would never be allowed

It is not a violation, since they did not release any information about your medical condition to anyone

If it was just your photo and did not contain the words "taken from a rehab facility" imprinted on it, then no, it would not have been a violation. Poor taste, yes. You could have just insisted on signing autographs on plain paper and skip the photos instead.

If someone is that excited to have you there in person you need to remember that fame does come with a pricetag attached. You need to look into buying some plain paper for just such occasions.

Thank you guys. Yes the name of the facility is on the pic. I had to hold up a slate like a mug shot:( they told me that the pic was only to admit me and it would never leave the facility. Lawyer said its not just a hipa violation to copy my pic its also a federal offense ! 8-o

Is there a statute you can provide for this? I'm always interested to learn new things; I've never heard of it being a federal offense to copy a picture.
