View Full Version : Adoptive parents want to voluntarily terminate their parental rights

Our 16y/o adopted daughter is adjudicated unruly and classified as a dependent child. She is in foster care with no chance of returning to live in our home as she has many behavior issues that we are not equipped to handle. We are being charged high child support fees including 100% medical payments. My husband and I are 61y/o; I am disabled, he is unemployed for first time in his life. This is all causing extreme hardship for us! We want to voluntarily terminate our parental rights to help ourselves as much as possible. What can we do? We live in Ohio.

If no one is stepping in to adopt her, then the likelihood is that you can't do anything.

You are responsible for her welfare because you are her parents.

You don't get to just bow out of being a parent because a child is unruly, whether the child is yours through birth or adoption.

I was told by the CPS that they can only go after you for a certain percent of your income.
See if they have any hardship forms that you can fill out to have your payment adjusted if you haven't already gone through court recently.

This is why a court must approve an adoption. They need to be sure that the adoptive parents understand what they are gettng themselves in for.

Maybe you didn't read the fine print just as you ignored posting instructions. There is a Read First note at the top of the Adoption forum (where this was originally posted) that directs legal questions to this forum.

Just like any other parents that have their children biologically... you can't just sign away your rights. Is there another family wanting to adopt her? If so then you two can allow the adoption but other than that the two of you are her parents period. As someone mentioned see if there is a way to reduce your support payments based on the inability to pay. Were the support payments calculated before or after your husband became unemployed? If it was before then there should be a modification done.
