MY aunt adopted my two kids when my rights where terminated my ex-husbands rights also where terminated due to him serving a jail sentence for having sex with a minor 4 years ago. Now my ex-husband served my aunt with custody papers is he able to gain custody of the kids once they've been adopted?

There is NO way a sex offender is going to get custody of ANY kids and no an adoption means RIGHTS terminated.

How does he have custody papers anyway?
Are they old papers from before all this happened or what?

The papers are recent my aunt who adopted them received them 5 days ago so that's why I was concerned because why was he able to file for custody being that his a sex offender.

Maybe the court or lawyer just saw a sucker that was willing to spend some money.
You can sue for anything but winning is a different story. So I guess it may be the case with this. They took his money because he was willing to give it.
You can't overturn an adoption and I doubt he has a leg to stand on to even come close to winning.

Im going to go out on a (very sturdy) limb and say that there is not even a minute chance he gets custody back.

If the kids were adopted legally, there was no realistic chance anyway... add a sex offender charge against a minor... and seriously... it won't even see a court room. Its harassment at best and a lawyer filing some BS paperwork at $200 an hour.

Not a chance that will happen, make sure your aunt files to recover her legal fees in this frivolous case.
