My son is 22 years old, a year ago he got a dui and felony due to sitting in car in parking lot, keys in ignition so he was considered dui even though not driver, he also had a zanetc on him in pocket, was perscribed them but did not have perscription bottle. He was given 2 years probation, 1 year dui 1 year felony. He pleded 1st time offender. In mean time my son did come addicted to alcohol and drugs, he addmited he had problem and went to probation officer and asked to get into itp program, probation officer agreed, he was in there six weeks, has done great. But problem is he got into argument with a concelor, 3 days before program was finished, they kicked him out, gave him 1 more week to take classes, he wnt monda, then missed Tuesday went wends. Was picked up for probation violation , probation officer said he did not complete program so he violated their agreement. My son has been in jail since last weds, goes before judge this thurs. I talked to his probation officer was told he wanted to do it his way now he is going to do it my way, he is wanting to send my son off to a male drug center lock down for 9 months 300 miles away then he is to finish rest of probation in this county. And report to daily drug classes every day. A legal aid lawyer has not been assigned to my son as of yet. Running ou of time, please help me. Can one person be punished for this length of time. Guess concerned mom, does he stand a chance of getting out of jail this week, probation officer is asking remain in jail until he goes to program for 9 months.

Parole/probation is a very sticky situation. There is a lot of discretion within this department. You must consult an attorney.
