View Full Version : In default on school loan and already have a wage garnishment, what do I do?

Been in default on my school loan for at least four years. Wage garnishment for two years. I am a homemaker now. With the wage garnishment I couldn't afford daycare for two small children. I moved out of CA to MN where it is much cheaper to live. Would like to clean up my credit and pay start paying this loan off and gettting rid of this garnishment so that I can go back to work and make some money. What do I do? I don't know who my leaders are or where to start.

I don't really know a lot about that.
When I get laid off I put mine into deferment.
But with three small kids and if you aren't making a lot are you able to get the earned income credit with your tax return?
I would use that to get caught up some.

Is it a private loan through a bank or a loan like Stafford? Sadly the ease of fixing this depends. I know my loan went into default when I dropped my classes one semester then didn't go back the next. You can take up to 6 months off school with no penalty and not contacting them if it's a Stafford loan. When I went back to school I got my Stafford loan deferred because I went back and got a whole new loan, same bank and everything.

Are you going to go back or are you done with school? I'm not 100% about wage garnishment. If it was court ordered then you will have to go back to court. I wish I could tell you more but I can't not knowing the type of loan.

To find out call the school you were going to the last time you received student loan monies they should have it on file, if not you will need to get a copy of your credit report. If you are trying to fix your credit I recommend you do this anyway so that you are aware of what is on it.

The only way to stop a garnishment is to pay it off. Student loans are the exception to many rules, including IRS refunds.

I remember that you are married - are the children with your husband or your boyfriend? If they are your husband's children, file for child support.

I am not aware that you can get a hardship waiver from a wage garnishment when a student loan is involved but it would be worthwhile for you to contact an Attorney, perhaps one of the legal aid attorneys, and ask.
