Hi,

I am currently in the united states on H1B until 2012. In the mentime I would like to apply for green card. I have been in the United States since 2008.. first on F1 and then on H1B. I have a BS form the US and have my Ms thesis pending. I could complete my Ms by the end of this year.

The issue is that my employer dosen't sponsor green cards. Is there a way to file using a lawer?

If there is a way what category should I file under?

For most H-1B's, you will need a petitioner to file for permanent residence. There are a few categories where you can "self-petition", but these typically require at least an advanced degree, a numbers of years and significant achievements in your industry.

I advise you to update your resume and consult with an experienced immigration attorney to see if you qualify for the self-petitioning categories under EB-1 and EB-2. good luck.
