View Full Version : How to change visa from F1 to H1 ?

I came to US in December 2007 as a tourist . After that I change my status to an F-1 i.e a student in may 2008 .
Now I want to change my status to H-1 but I don't know what will be my next step. My uncle is a citizen here is it possible in anyway that with the help of him I can change my status .
And if yes how much time it will take after I filed my petition.

Please give me some advice or suggestions.

Have the company petitioning for you file the COS to H-1B as soon as possible. There are visas still available, you must be in status, or your OPT valid beyond October 1, 2009, the start of FY2010, when the visas are available. If you file with premium processing, the USCIS will adjudicate the case in 15 days.

Don't understand how your Uncle fits in to the H-1B. Does he have a comnpany to file the H for you?

Respectfully, it sounds like you should consult with an immigration attorney. Any attorney that handles H's should be able to take care of the case.
