I live in NJ. I live in a house that is registered as a vacation or second home for my mother. I was given the house by verbal agreement of my now deceased Dad and Mom. I rcently got in to an argument w/ my mother and she told to get out. I don't have a lease nor do I pay rent as per their request. I would like to know if my family and I have to leave immediately or if we can go through the eviction process first?

Most states have a 30-day requirement. This means that your mother would have to give you a 30-day notice to vacate. If you refuse to leave, she can then file for eviction.

I'm curious as to why you want to go the route of eviction, rather than just leaving. Evictions will show up on a background check; do you really want to take it that far?
