I was involved with the formation of a trucking company and promised ownership.
I signed a personal guarantee with a financial factoring whicb bought the company receivables under the pretence that I would be an owner. 6 months down the line I was lied to and defrauded by the trucking company official owner. I left the company and an official meeting was held at the factoring company. I advise them I would no longer be a part of the company or its actions. The manage then refused to have me removed as a guarantor.
I am now being sued by the factoring company for moneys owed to them. Apparently after I theft the owners of the company fraudulently double billed invoices and walked out on a $14,000 promissory note. All this while I was not with the company.
I must filed a denial letter on my behalf of the allegations against me.

Sorry, but if the factoring company is suing you, they have a valid case. You signed as a guarantor.

Now you have a case to sue the Trucking company for your losses.

Do you have anything in writing that shows you requested the end of your guarantor status and when?
