I gave my wife and her business partner $65,000.00 for the purchase of a property in Meaford Ontario. My name was to be placed on the title. They took the money and let the property fall into foreclosure, my name was never placed on the title.
Can I pursue fraud charges against my now ex wife and her partner in this matter?

Sure you can, but do you have any proof of the purpose of the funds?

I have nothing in writing between myself and the other two parties. The funds were from an inheritance and the estate lawyer did disburse a partial payment to me for the specific purpose of the purchase of the property and is willing to give me a statement to that effect.

Do you have any proof that you were supposed to be on the title?
From where I sit, it looks like you made a loan to your wife for her business. The investment went sour. Its going to be very hard to prove fraudl. Since the amount is beyond small claims courts, I suggest you consult an attorney to review whether there is a case or not.

Yes, real estate contracts have to be in writing.
Plus at the time it happened, when the deed was issued, why did you not do something then, why NOW.
