View Full Version : Legal to cut salary daily?

I work on average 45 hrs. a week. And am not paid overtime. Just $500/week. I was in a car wreck and out of work for a week. Instead of getting 500, he divided my pay out to 100/day and only gave me 200 for 1 week and 300 the other. Is this legal even though I am not compensated for working 5 and 10hrs overtime? This might be helpful: It's a 1 owner 1 employee(me) company, and I do get 1 week paid vacation and 4 paid sick days/yr. Thank you

I had already used my vacation and sick days for the year, which also confused me when I started thinking about this situation.- Why would I need or have sick days if I'm on salary

Salary laws do differ by state.
But yes if you are out of sick and vacation leave, the company does not have to pay you. Many companies as part of their company policy will pay you, but they are not required to.
Now the issue I see, if you were only out of work for one week, why they pay was divided
You would get a full 500 for the week you worked. The week you did not work would or could be none.
